How to Immigrate to Canada from the US - CUSMA

In this post we shift our focus to temporary resident options for those who want to come to Canada fast but won’t have enough Comprehensive Ranking System (CRS) points to do so without gaining Canadian work experience first. Work experience gained through temporary work can also be used in Provincial Nominee Program (PNPs). Keep reading for more information on the only immigration program that comes close to being designed for American citizens.
While it still exists, the Canada-USA-Mexico Agreement (CUSMA) allows eligible American citizens to work in Canada in specific, limited capacities for up to 3 years at a time. It isn’t necessary for the employer to be a US company in all cases, and the program is also available to Mexican citizens.
1.Professionals
Appendix 2 of CUSMA contains a list of 63 professions eligible for 3-year work permits in Canada, with the possibility of renewal, provided the applicant has a job offer from a Canadian employer. A CUSMA professional could then be eligible to apply for permanent residence through Express Entry after one year of working in Canada.
2. Traders/Investors must work for an American or Mexican corporation. Traders must carry out significant trade in goods between Canada, the US, or Mexico. Investors must have made or make a significant investment in Canada in a real and active commercial or entrepreneurial enterprise and must be coming to Canada to work as an executive, advisor, or in a position involving essential skills for an American or Mexican corporation in Canada. The initial term is for 1 year, extensions are possible, but the application must be made through the visa office in advance. The nationality of the corporation is a crucial eligibility factor.
3. Intra Company Transferees (ICTs)
For those working for a parent company with a branch, subsidiary or affiliate in Canada, there are three types of skilled workers eligible for work permits of up to 3 years under the ICT program: those working in executive, senior management or specialized knowledge capacities. All three types of workers must have been employed continuously by the American corporation for at least one year in the three years prior to application.
